Would buying a house with planning app in for extension next door put you off?

    Since that was my initial reaction to the OP message. But then....I'm unsure as to whether one could use "potential property devaluation" or "potential loss of sale" as a justified objection. I think one couldn't, but I really don't know.

    You can't use that as a reason. You have to give planning reasons to the planning department.
    No reliance should be placed on the above! Absolutely none, do you hear?

    I can confirm you that this is not a valid objection. I once called my local planning dept. asking specifically for this.

    probably it would put me off, although, it sounds they don't have much chance.

    but, realistically: if the application went online yesterday (Wednesday) and you are exchanging, say, on Tuesday, these builders shouldn't have many chances to find out about it, especially because their solicitor will probably have done all relevant searches and enquiries by now.

    btw, how did *you* find out?

    I found out by the neighbour they approached me... I did say that this could cost me the new house doing this now but they didnt seem to care and why should they! I did say as said before i was surprised as their house been on market 3 years and they said they still leaving it on as per previous posts but have no intention of moving :mad: I know that searches on a property for buying are only for your house and say if the road was going to become a motorway or something similar. My concern is that if we do receive a letter from planning and don't notify our solicitor or builder could i be doing more damage than good. Its easy to say don't worry but when you are so far down the line it's very hard not to remain detached from it all. As for it devaluing my current house then surely if i did lose the sale of this because of their planning app then i would go to council as its not very fair on me is it to lose cash just because someone wants to extend????

    are you sure you are obliged to notify them upon reception of the letter? in any case, once you have exchanged, it probably won't be convenient for them to walk out, especially if the chances of the application to be accepted are low.

    if you receive the letter and have to forward it to them, the best thing you can do for the potential buyer is to oppose the application in writing.

    as I said, as far as I know, this is not part of the criteria to reject an application.

    the best thing you can do now is to call the planning dept and ask for information. ask them how the process works, what are the criteria that are usually taken into consideration, etc. if they can, they will help you.

    Reduction in value of your house is not a valid planning consideration, but of course it's a valid spur for you to find other (valid) reasons to object.
