Lega Aid Application (Scotland)

Hi All,

I am potentially about to make an application for Legal Aid (in Scotland).

I separated from my ex-wife 2 years ago and she has continually stalled the process of me having contact with my children. I feel I now have no option but to pursue a contact order, but I cannot afford to pay for it out of my own pocket.

We both still jointly own a property which neither of us have lived in for 18 months. It is currently on the market and has been for the last 2 years.

My annual salary is 32k, but I am currently paying rent on top of half the mortgage on the marital home as well as paying off around £16k of marital debt, so my disposable income once I have paid for everything is less than £100 per month.

When applying for Legal Aid, do they take into account your disposable income or do they just look at the top line salary figure and base their decision on that?
