Taking it to ombudsman as denise doesnt seem to grasp that as my account number has never changed the payments i have been continually paying since 06/07 to that account will have paid the supposed final bill from 09. Sadly this is beyond her comprehension, and when I have asked her to provide me with a breakdown of where my payments each month have been applied, what the account balance was at the time, so that she can see herself the amount will have been applied to the account and subsequently paid by the monthly dd she has asked me to pay to get this. She also ofers no explainaton as to how if i have owed this amount since oct 09 on this account why I have never had any letters about it, or why my account hasnt been stopped?

AVOID BT. They are totally unreasonable and incapable of understanding basic concepts.

    Sorry Stephanie but ...............

I Left BT in Nov 2008 to join Sky with my t.v broadband and line. They sent me a final bill of £154.00 !!! Joke, reason why I left. However i couldnt pay it all at once at the time, due to other circumstances, anyway, they said that's fine but I had to pay through the "Debt" People. Again, fine. Paid it off within a couple of months, account cleared. ................. OR SO I THOUGHT! Just recieved a letter from a different debt agency saying I owe bt £154.00 plus their charges !! SPOKE to BT today who said "Sorry we have no record of this being paid and its now in the hands of the debt agency, speak to them"!! EH !! I also called the original agency, who again HAVE NO RECORD OF ME !! I existed every month. !!
So now I have to go through the rigmarole of digging 2 year old bank statements out trying to prove that I paid it. Why should it be left up to me !! Its their incompetance !!

So im not the only victim of this!! If it cmoes down to court action would you be willing to provide me a witness statement showing that BT have done a similar thing? Im still astounded by being charged for information to show I owe the money they alledge, isnt it their job to PROVE I owe it? Cheeky gits. Cant wait for the ombusdman to get back to me.

Your contention is entirely correct. If you head over to the DebtFreeWannabe forum, they have a template letter for just this - the 'prove it' letter. You should be doing everything in writing now - not phoning. Keep copies of everything you send. And keep an eye on your credit files too. BT will not be above trashing your credit record.

If BT are using the Debt Collector as their Agent, you should correspond with BT. If they have sold the alleged debt on, you should deal with the Debt Collector - you can assume BT still own the alleged debt, you will have been sent a 'letter of assignment'.

The reason for sending the 'prove it' letter is that it can prove a valuable piece of evidence that you have tried to sort the matter out if it goes to court. Both parties are expected to try to sort the matter out before it goes to court - and if it does go to court, you are entitled under rules of 'discovery' to receive the info you are requesting without charge.

Thanks again for your helpful advice, I shall send them that letter. This is exactly why I refused to deal via phone. Thanks!
