    I would strongly recommend reading up on some legal advice on this and perhaps speak directly to trading standards who would have an official line.

    I remember watching a BBC investigation into rip off goods that were made in the same style / pattern, etc - which effectively breached IP and copyright. I'm not 100% clear on the law, legalities - but definitely do check!

    Also, it always helps to make it clear in your description. For example, I remember when the iPhone, the Taiwanese (as they do), brought out iPhone-like smart phones, which of course, aren't from Apple. Same style, etc - no logo. They explicitly labelled it as 'NOT iPHONE', which is why I think eBay continued to let them sell it on their site.

    This is an interesting topic and I imagine it must be a very fine line. For example doing an exact copy of the burberry check pattern would be passing off...not that that stopped a lot of copies though. However the red polka dot pattern used by Cath Kidston is also used by a lot of leading brands as it is a generic pattern. Using the Cath Kidston floral patterns and colours exactly would probably be passing off though.
