Faulty Windows on Home

Hi there,

Hopefully someone can shed some light on this for me as I seem to be getting nowhere!

When I bought my house (new built 1st owner) in Sep 2006 one of the faults which was found was on a bedroom window, as they demonstrated how the window could be moved to allow you to easily clean it, the window almost fell out!! So at the time they literally just stuck another screw in, maybe not the best idea...then that was that.

Now we never used this "feature" at all, probably because it didn't seem very safe to do so going forward, until a few weeks ago. As you can guess, when opening the window and then moving it, the screw fell out again and the opening window does not shut properly meaning the wind howls through it, very annoying!

Finally - the whole window frame in this one room appears to be ready to fall from the house, large gaps all around the top and if you push it, the whole frame moves about.

I have spoken to the Builder, who as expected were not interested as it was "outside of 2 years" (even though I mentioned ot them the workmanship to start with was obviously below par) and they suggested I speak to NHBC who told me it was not covered by them so I should speak to the governing body looking after windows, this seems very odd to me as surely it's the builder who are at fault and not the window manufacturer??

Can anyone shed any light please as to where I stand? They have all suggested I used my home insurance but I do not believe I should have to fork our for premium increases and excess due to a poorly installed window?
