Tribunal

Hi there.

My Son lewis has severe scoliosos(wears a back brace 23hrs aday) and type 1 diabetes. We applied for dla for the scoliosos back in september. We got refused so we now have tribunal on 2nd june.. I had a welfare rights officer coming with me but have just had a phonecall to say the person who was coming with me is off sick and most probably wont be back for sometime!!

Is there anybody else i could ask? has anyone on here did it alone?

    Thankfully I've never had to go to appeal but, picking up on the way you've worded your post: DLA won't be awarded on the basis that he has scoliosis but on the care and/or mobility needs that he has. So, if I had to give you one bit of advice it would be to concentrate on making sure you have evidence to demonstrate that he has the needs you identified in the application.

    Thanks.. Im not applying because he has scoliosis im applying because of the care needs he now has. Much more than an average 8yr old

    I would recommend thinking about ringing up the tribunal service and explaining the situation and discussing the possiblity of having your appela postponed until the representative (or another one) is available.

    Success rates are higher for people who go with a representative.

    Please don't cancel your appeal - there is a 10 month waiting list for appeal. The welfare officer would be there to 1) povide some support and 2) to make sure the panel did everything above the law.
    However they would not be able to speak for you and you would have to do 100% of all the talking anyway and I have never heard of anyone who thought the panel went against the law. So all that you need now is some support - you can get that from a relative/friend (if they will go to appeal with you).
    The panel are only there to look at your evidence and are nice people (independant from DWP) so don't worry - go to the appeal

    my son's tribunal was two weeks ago.Which we won, HRC & LRM. I did it alone. If i can be any help please drop me a PM. Good luck

    If this was true, there would be few cases of needing to appeal the case to the upper tribunal.
    The lower level tribunal does make mistakes in applying the law - but in general this would be grounds for an appeal.
