Item Missing - Ebay Auction - Help

Hi.
I have bought a RC car on ebay and the description is listed below. The listing described the car as basically everything needed to use it (apart from batteries which I expcted)
I have opened the box earlier and the receiver is missing the aerial thus rendering the product useless. I have text the seller to tell him of this and he said he thought he put it in the box and he said he would send it me if he can find it. I have looked on the internet and most places appear not to sell the actual reciever antenna on its own just the whole unit itself. I have found a few places who do stock it but most are out of stock of the aerial itself. Where do I stand in this? Do I buy a reciever and send him the bill or how does it work?

TT-01 with custom Subaru shell
The car has drift wheels, locked differential, forwards and reverse speed control and is shaft driven 4 wheel drive. It has a Kyosho handset and is complete with box.
The batteries included are 2x 1800 milliamp, 7.2 volts and 1x 2300 milliamp battery that is also 7.2 volts
also comes with an Ansmann quick charge pack with mains or 12v connection, quick charge lets you fully charge your battery in 30 minutes.

If he can't find it you have 45 days to open a SNAD case. If you are happy to keep it if the seller sources the missing piece, then suggest that to him, I would give him a day or so respond to your earlier text.
Instead of texting the seller it would possibly be better to go through ebay messaging.0 -
Yeah if possible ebay the seller, They could source the item as stated, perhaps failing that give you a part refund to cover costs of buying one yourself.0

Im more than happy to keep the car its not an issue. If I dont get a reply by tonight (given he will be at work now I assume) I will send him a message on ebay.

He said he has sent it as its not at his house so should be in the box. Advised him there was nothing there so he said he would send one if he could find it.

Open a SNAD case through Paypal, you will have to send the item back tracked at your expense though.
I think that there is an option to ask for a partial refund, if so and you can source the missing part ask for that amount to be paid, if that's what you would be happy with.0 -

I want to keep the item as im happy with what I got bar this little item shall we say. I will look at opening a partial refund later and see what I get. Is it a quick process?0 -
The time scale depends on whether the seller plays ball or if he lets the case close against him. He may respond straight away offering to give a partial.
Are you sure that the car actually works if you need the antenna, or are you assuming that it will be ok? If that's the case & it was expensive then I would be tempted to go for a return & refund, or buy the bit needed & try it first, as if you accept the partial & then it still doesn't work you can't open another case as far as I know.
Could you take it somewhere locally where they sell the bits & test drive it?0 -
The car doesnt work without an antenna but LUCKILY I am selling another car which this one replaced which I am borrowing the antenna for that one so yes and no. Officially I still havent been able to use it as long as the item sold to me is described0

This happened to me this week, I sold an electrical item but when I came to pack it, the adaptor was nowhere to be found.
I bought an adaptor off ebay, put the buyers address in as the delivery address and emailed the them to let them know what I've done.
Fingers crossed the buyer is ok with it. Perhaps your seller could do this for you?0
