    Yeah i agree with you on this one after all it is them claiming this and not me. I think its pretty obvious to me that they are just hoping to fob me off. My letter is going in the post oh and of course polite to the utmost lol.

    in response to ROONALDO i hear what you are saying but they have wrote to me and said that this so called telephone call took place in 2001 so that immediately says to me that they have the appropriate evidence to back this claims. Am i right in thinking that if they can't provide evidence of this sale or any paper work ie the agreement that santander would be inclined to pay back this money?

    I think they probably just have a note on your account on their computer system that the sale took place, or perhaps not took place!

    there is no legal requirement for them to keep all the records, so they dont have to provide documentary proof anymore if it doesnt exist, but you are right to challenge it.

    If you're adament that they never called you and sold you it, get them to provide the proof that they must be relying on.

    Yeah i'm quite adament that this sale did not take place.....why would I suddenly add this insurance after 3 years of not having it???????? seems a bit strange if you ask me. I have wrote a strong worded polite letter asking for any evidence of this sale and any forms they sent me of this sale.
    However, as they probably wont have any actual evidence to show me (because this was in 2001) am I right in thinking that they cant enforce this Insurance????? Therefore I hope to get a refund or I'm off to the FOS.

    firms often look at accounts with no ppi on at later date, call you and persuade you to take it.
    as they probably wont have any actual evidence to show me (because this was in 2001) am I right in thinking that they cant enforce this Insurance
    the insurance is still enforceable, a (assumed) lack of sales evidence doesnt make the insurance invalid. if you paid your premiums you would/should be covered.

    when I was at FOS, I rejected complaints with little or no evidence, just due to the amount of time that went by. like what marshalka said, FOS do look at the proababilities.
  • I know this sale supposedly took place in 2001 but i would never have agreed to commit to buy anything over the phone. I have searched within all my financial records and cannot find anything regarding this insurance i have supposed to have agreed to too!
    I have the original copy of the agreement so i know i wouldn't have thrown this away!
    I think they have just added it without my knowledge.
