I have had my virgin credit card for allot of years Ive never claimed anything on my insurance which I pay allot of money for each month. Im only 32 and have worked since I was 16 and paid all my taxes. I took a job at a stables 3 years ago and havent been off sick longer than a few days I do not earn enough to pay national insurance and my boss pays £5 less than whats required to recieve SSP. I only found all this out in Feb when I was diagnosed with stage 3 breast cancer and I asked my boss where my SSP was? only 3 years I havent paid NI they dont include the rest of your years working?? My employer never mentioned any of this! Ive had operation after operation since Feb so I have not been fit enough to go back to a manual labour job I start chemo this week so the next 8 months is out. So as I said I found all this out and I cant work Im not getting SSP and no help from the goverment other than my national insurance credits being paid, Ive never taken hand outs and never thought I would but as its turned out Im not getting any help or money coming in. I have PPI with Virgin I thought at least thats one thing I dont have to worry about, WRONG recieved a letter yesterday saying they will not pay out on my claim because " You working for remuneration under a contract of employment and paying class 1 national insurance" now Ive taken an insurance out to cover me incase Im sick regardless of anything else I pay my bill each month and the insurance so it shouldnt matter. They said they will not let me appeal!! I am sick with worry if cancer isnt bad enough!! Ive no idea what to do let alone have the strength and energy to be this stressed, my insurance has screwed me my work has screwed me and the goverment has screwed me!! Its shocking!! Anyone out there know what I can do?

"You working for remuneration under a contract of employment and paying class 1 national insurance"
Do you mean they won't pay out because one of the conditions of the PPI is that you have to earn over the NI limit to be entitled to claim? If you check your original PPI paperwork is that clause specified in the T&C?
If it is then they are entitled not to pay out - you could have cancelled the PPI at the point you took the job that earned less than the NI limit (although I'm sure other people would have forgotten to as well).
If you did earn over the NI limit when you took out the PPI then you would have no claim for making a reclaim.
I don't know about the benefits situation - I would have thought you would be entitled to claim something if you are not being paid anything from your employer - even if it was only income support whilst you are unable to work - might be worth trying to speak to cititzens advice on what you might be able to claim or posting on the benefits board of the forum for some advice.
If you cannot afford your virgin card minimum payments then I would write to them and offer them a £1 token payment until such time as you are working again (this will affect your credit file but if you cannot afford the payments then it is best to be in contact with the and explain this rather than just miss payments).
Edit - according to this http://www.direct.gov.uk/en/MoneyTaxAndBenefits/BenefitsTaxCreditsAndOtherSupport/Illorinjured/DG_10018786 then if you cannot get SSP then your employer should give you a SSP1 form and you may be able to put in a claim for ESA.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
My claim rejection has led to bigger problemsI've had the card for more years than I can remember and I cant find the insurance booklet. When I took the card out I had a £30K a year job but had to leave due to my dad dying of cancer and had to nurse him at home. I have been appplying for jobs for 3 years since and took that job to tide me over. I've always had a decent employer who did things by the book she knew she was doing everything by the minimum except for me. I didnt realise that not having national insurance caused so much problems I thought because I was working I had a tax code and Im not claiming benefits I was ok. I am obviously wrong. Ive been to citizens advice Ive spoken to all goverment channels all they will give me is NI credits. Ive done all appeals Ive tried everything I was told if I was a single mum or an immagrant or a drug addict or alcoholic I would be helped, yes they actually said that. Even my health insurance said if I die in 12months they'll pay out which is no use to me just now?? Ive worked very hard since I left school Ive paid everything that I should I've taken insurances out galour, now I cant eat, I can't pay bills, I'll lose my home.....maybe its best to have never worked at all and learnt how to play the system0
