Council tax single occupancy - can i get a refund?

Hello everyone, I'm new to this so here goes..........(be gentle).
I have applied for a single occupancy discount from my local authority. My house has had one adult for the last 5 years. My Local Authority will only discount from 1 April 2010 and have said "every year when the annual bill is issued details of various discounts are given to ensure that if a tax payer is entitled to a discount or exception, they may claim for it without delay".
I recall I claimed for the discount in the first year. I did not recieve anything further notifications from the council and thought the discount would be applied every year until I informed them otherwise. The discount form does not state it needs to be completed every year.
It was only by chance that one day whilst bored at work I sent them another form with a note politely asking them to check if the discount was still being applied. I found out it wasn't, though they will back date it to April 2010.
I guess my question is, am I entitled to get a refund on previous years?
I'm abit annoyed because this may be my own damn fault for not renewing the discount every year but then how was I suppose to know I had to apply every year if no one told me?

According to the information from NHS Carer's Direct you can backdate Council Tax Discounts to 1992 providing you have the appropriate evidence.

There is nothing in the regulations regarding the time limits of backdating discounts however the council do need to be satisfied that it applies for the period in question.
Assuming the council refuse to backdate then the only option you would have would be to appeal to a Valuation Tribunal.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
