    Just work the hours and then put in a complaint to the NMW office
    (If you can list all the people affected and all the times it has happened it might help).
    I would agree with this. OH should take a piece of paper and get the trainer to sign for his attendance and the hours [as evidence for the NMW claim]. Courtesy suggests that the boss should be told upfront that a NMW claim will be made, but I think that the boss should know better and pay for her ignorance.

    I would say that the original interpretation (that they attend in their own time, unpaid) is correct. "...will continue to pay" refers to the fact that the person giving the training costs money, but that that cost will be borne by the employer.

    NO, do not tell the boss, they then know who complained.
    requesting records could be an issue but get the request to work/attend in writing or try to get the investigators to turn up to the training.

    It was 35 years ago I got involved in NMW complaint*, things may have changed but I think the best approach still is....

    Treat this as an annonymous complaint to the NMW people, but give as much detail of the people affected and dates, these details help them do a proper investigation, make sure they find as many people being underpaid as possible to avoid recriminations at a personal level they can't sack everyone.

    Look as supprised as the others when the investigations happen.


    * in my case it was low pay, illegal deductions and illegal underage workers that had to hide in the cellar when the investigators turned up, turned out they had this happen every year as summer holiday jobs in a seaside hotel complex, they were known to employ kids/school leavers that did not know the rules.
