O2 downgrade tariff T&C's change

Hi there, hoping someone can help me on this - I upgraded my O2 phone last year to an iphone, upgrading to £45 per month, to pay a cheaper price for the handset. At the time, my T&C's stated that I could downgrade to the next lower tariff after 9 months, and then downgrade 1 tariff down every month, if necessary. Well I have now reached my 9 months, and went to downgrade for the 1st time, only to be told that the T&C's have now changed, and so when I downgrade, I will be signing up to these, which state that you can only downgrade once during your minimum contract period.
As I'm sure many other people worked out, it was more cost effective on the old T& C's, to sign up to a higher agreement, and to pay a smaller amount for the phone initially, with the intention of downgrading it later on (from memory, it worked out to be £20-£30 cheaper overall), which I'm sure O2 have now realised, and hence the change to the terms.
But can they do this, anybody else had any similar experience?
