On the other hand, since you've got your money back, you might be better to just get your cc provider to recover the £37, and then forget about OE and you can go to someone with a better policy for dealing with problems, in case the varifocals don't turn out to be comfortable. Some people are comfortable with varifocals, some are not.

However your section 75 claim against that particular merchant is only for the £120.00

the consequential losses ie the report you have had to pay will in all likelyhood be dealt with seperatly.

I know that how we work we would issue a f&F for the transaction amount and just issue a good will gesture credit to cover the £37 i think you said it was.

A simple call to the bank in question is going to clear this up - bottom line is if they have asked for it and the report is found in your favour they are liabile for the cost of the report too.

Could be an oversight - could be already dealt with.
