    i made the mistake of going on to JSA and was turned down again, jobseekers allowance is for those seeking work i know you can work on IB but the point is IB is for people on long-term sickness, i take it they will view it as 'you can work then' so knock you back, they just refused my appeal and upheld the original decision.

    remember they are trying to get people back in to work regardless of being on IB, if you read the articles in the news a few months back the government is actively tightening and trying to get people off IB, they have even been recording conversations without the claimants knowledge.

    if you can work then by allmeans go on to JSA, but i know what they percieve things as, i learned the hard way.

    its just me playing it safe!

    Your appeal being refused would have had nothing at all to do with you claiming JSA, it is NOT considered, that is a FACT. I assume you attended the tribunal.

    At the moment the rules for IB have not changed and the only conversations recorded are for monitoring or training purposes and are not used in any other way except maybe fraud investigations.
  • The above answer from healy is 100% correct and while the government do have plans to change IB,these changes are still to be implemented.They may be in 2008 when they have passed through the parliamentary process

    ok so its not the case then if it all, the article i read was on a registered website and i thought you are supposed to be notified when calls are recorded ?

    First of all healy, and everyone, I appreciate your time in replying to my post ..... I was waiting to see what happened on Thursday before replying back - as my situation stands at the moment, my IS payment went into my bank account in full as per usual on Thursday. I have not received any confirmation letter of my medical assessment results or any phone calls regarding this. So should I ask my advisor at JobCentre Plus to chase it up??

    How long do you have before you can appeal??

    With regards to your comment healy about JSA, I understand what you are saying with regards to it being the higher rate of money, and that I can still appeal whilst claiming this. But, whilst claiming JSA and awaiting the result of an appeal, I would still be obliged to job seek, and at the moment I don't feel right in myself to do this.

    And if I appeal, and go on reduced rate of IS, I can still access my disability advisor at JobCentre Plus, and get access to their services, such as a scheme they operate helping people like me with problems, getting back into the workplace, and being offered placements with companies who may be a bit more understanding. Plus a Condition Management programme, which helps you to find ways of coping with your condition better.

    So thats how it stands at the moment..... :confused:

    Yes you could ask your adviser to check for you but I would imagine the letter has been held up in the Christmas post with the Bank Holidays.

    You have got a month from the date of the letter to appeal.
  • Hi just wanted to ask a quick question to you guys off the back of your convesation. My partner went for his assessment about 4 wks ago and had a letter befor xmas to say his IB was stopped as of 1st Dec. I think he has filled out the necessary paperwork to appeal, but in the mantime where do go from here? He is not fit to work, ( don't know they could not see that as he has back problems, physio therapy regularly and serious IBS) and this month is my last basic maternity leave payment.

    When you appeal against an IB decision you are able to claim either JSA or a reduced rate of Income Support.

    Has he got help in filling out the forms etc and in appealing? If not tell him to get some help from teh CAB or local Welfare Rights service - they can help with forms etc and even attend appeals. I wouldnt have won mine I dont think without the help from the CAB! There is a higher percentage of successfull appeals with representation.
