Brookscroft Management Ltd & another PPC

It has recently been brought to my attention by a local resident whom I now understand lives in a private road that is managed by the following company "Brookscroft Management Ltd" http://www.galet.freeserve.co.uk/ and the rather harsh way they seem to be dictating to the local residents and by their over zealous use of a PPC to ticket and even sometimes clamp vehicles.

If you look at the Brookscroft website and view their BML DOCUMENTS and select "Parking Regulations" you will notice they like to use the word PENALTY and I would like to help and advise my friend how to bring this PPC to task.

They are issuing Parking Charge Notices that I have advised him to ignore, but they fear being clamped as it is not unknown where they live...

Any advice please?

I will also need to get https://www.capitalcarparkcontrol.co.uk/ added to our ignore ppc chain, I am waiting to get some letters to scan in for all to see.

Well its not a lot you can do about the word penalty on their site, except to complain to them about them acting like an authority , to which they probably will ignore.

As for the PPC, just ignore them as their invoice is unenforceable, if they clamp for past alleged debts, they are acting illegally, and if it was me I would be inclined to get an angle grinder and cut the clamp off, or to call the police, the problem with the boys in blue is that they say its a civil matter very often, even though its a criminal matter, so I refer back to cutting the clamp off.

It is also possible to sack the management company and replace them, though its very complex and a lot of work, alexi on here knows more about that.

Not so - UK marketing via websites recently came under the provisions of the CAP Code and operators are required to adhere to its basic principles.

I disagree. The comment on the website could well be crucial to providing evidence of the thinking behind the application of "charges" by the PPC. I suggest that screen grabs of this are obtained (dated and timed) so that anyone receiving a "charge" who might subsequently be pursued to court may use it as evidence of the real intention.

Oh dear another AOS member who seems unable to adhere to their Code of Practice. No doubt, like others, they have been given a dispensation to continue to use the word whilst the public continue to read that it is outlawed. I wonder if the courts are taking part in that dispensation scheme? Methinks not.
