The DSRs allow some freedom for retailers to decide when the contract is concluded - any e-tailer that has proper terms would make this when the goods have been despatched due to all the previous cockups with pricing errors when contracts were concluded as soon as the consumer paid for the goods (and it was too late for the retailer to check the order and back out).

It would of course also depend on the terms and conditions of the contract. Many online suppliers now state something to the effect that no contact exists until despatch. If that is the case then you have a very valid point.

I agree, I've seen T&C's stating the contract is concluded once dispatched and also once delivered.

John Lewis state " acceptance of your order takes place when it leaves our warehouse" but nothing on when the contract is final.
