what does this letter mean???

Hi all,

I've posted before about my OH - he was made redundant a couple of years ago along with quite a few others. A couple of people took this to tribunal and was successful in their case for unfair dismissal and were awarded a considerable sum of money. The tribunal finished just a couple of months ago.

Today, out of the blue, hubby has received a letter from his ex-employer saying they have been instructed to request that he obtains a Benefits Statement in respect of his benefit entitlements received and to send a copy to them.

They have given him a Benefit Delivery Centre address to write to and request the information.

What is a Benefit Statement and why after nearly 2 years would they be asking for one?? The letter gives no indication of why they want the informaiton just that they have been instructed to ask him to get one!

I have googled but all I can find relates to pension benefits statements.

Any help would be very much appreciated.

    I would guess that your OH is also covered by the Tribunal result, & the ex-Employer is being a 'good egg' and recompensing all who left in similar circumstances, not just the guys who took it to Tribunal?

    If that is the case, your OH wouldn't have been entitled to Benefits (JSA, ESA?) as he was still covered by £££££ from employer - so the Tribunal award will be made in full, with the (now) incorrectly claimed Benefits being returned to DWP.

    If your OH claimed nothing, just get that confirmed by DWP instead & send it off.

    Was your OH one of those who had a successful tribunal claim?
    If so, the compensatory part of the compensation awarded could be subject to recoupment of certain benefits if they were received during the period for which the compensation was awarded.
    e.g. loss of earnings from dismissal to the hearing date.

    If your OH didn't make a claim I can't think why they should ask him for this information; unless they've misunderstood the instuctions from their solicitors and think that they need the information from all those made redundant rather than just those involved in the successful claim.

    No OH wasn't involved in the tribunal case - I think there were just the 2 of them who made a claim together.

    I'll send off for the information and see what happens.

  • Not sure. A female family member who had to leave army when pregnant got a payout years later after a test case/tribunal. She hadn't made any claim herself. She turned down 1st offer based on their predictions of her lost earnings and in tne end got loads more than they offered.
