Me personally, id remove it and go and put it on his doorstep, and tell him not to use the boilier. Obviously it would be wrong, dangerous etc...but in society today, if people done everything by the book, and to the letter of the law, we would NEVER get anywhere. Everyone has there own opinion, thats mine.

But do what you think is right.

Now you are just being plain stupid,
Oh you mean the brakes thing. I guess you don't do irony then. Just as dangerous as what you are suggesting. You, Sir, are either being terminally moronic or deliberately obtuse.
so can legally (civil matter) be removed.
A balanced flue is part of the Gas Train wherever it is situated. A GasSafe registered engineer may work on it at the owners behest. A GasSafe Engineer will not work on it at the OPs request. Watch my lips please THE OP MAY NOT REMOVE THE FLUE HIMSELF AS HE WOULD BE INTERFERING WITH A GAS APPLIANCE AND IN DOING SO HE WOULD BE COMMITTING A CRIMINAL OFFENCE. Understand now or would you like me to shout it a bit louder?
As long as the neighbour has been warned, the act of interfering with a gas appliance would not apply as the op wouldnt be fixing it or inferring that it would be safe to use.
    Irresponsible and dangerous nonsense.

    Which you are entitled to.
But do what you think is right.
All he has to do is get the responsible authorites in the Council involved - its so simple. Why are people making it so complicated by advising him to do something that is just plain dangerous and could result in his prosecution.
