Can someone expain the law in this kind of circumstance. If they have taken the money from your card account is that not confirmaiton of a contract, therefore they are due to honour the price?

oh well, worth a try lol

Thank you for your recent order for an Apollo divan set.

I am sorry to advise you that this bed was priced incorrectly and should be £499 (plus delivery).

We do take errors of this kind extremely seriously and have consulted with Trading Standards officials and our own legal team and they have both confirmed that since the price was clearly incorrect we are under no legal obligation to honour it or proceed with the order.

This is also detailed in our on-line Terms and Conditions which state that:

‘Dreams Plc retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.’We have, therefore, cancelled your order and refunded any monies paid. Please allow 72 hours for this to appear on your card account.

Should you wish to re-order at the correct price, please visit our web-site - www.dreams.co.uk.

As a gesture of goodwill and to apologise for any inconvenience caused we have reduced the on-line price to £449 for the next 24 hours should you wish to proceed with your purchase.

Once again please accept my apology for any inconvenience caused.

No. Most companies nowadays have in their T&Cs that the contract is formed on shipping.
Also, if you wanted to take them to court, you would lose as it is clearly a misprice.

Did you really expect a company to give hundreds possibly thousands of beds away, and then watch them go in to administration etc

After the dealings I've had with them, when I ordered 2 beds at the beginning of the year, they would be doing any future customers a favour if they went into administration. They are without doubt the worst retailer I have ever dealt with.
