    You have to think about it in another way - the council will only house people who NEED housing.

    When you give notice you are not telling people to leave directly, you are giving notice that you intend to tell them to leave, ultimately by means of a court order which is the only thing that can end a tenancy unilaterally.

    Until they have the court order they have every right to stay in the home, so the council logic is they don't yet NEED housing.

    Yeah I understand what you are saying but as Colin pointed out Government guidance says the Council should not partake in this sort of thing. They have really messed about with my tenants upset them given them false hope stressed them out and stressed me out. If they hadnt told them to ask me to write a letter in the first place there wouldnt have been a problem.

    I have spoken to the tenant this morning and they are thinking of staying on until the baby is one year old which is when they baby will be looked upon as a person (for housing purposes) which suits me as I will retain good nice tenants for 6 or so months longer.

    Overpaying the max 10% per year for the next 2 years until July 2013 when I can remortgage and should be able to get down to 55% LTV.
    Overpaid 10% £10,619.87 Dec 2010 & 10% £9,475 Aug 2011
    Mortgage was £690 now £560 :D
    Currently £85,203 - 71% LTV 26/08/11

    It's not standard practice in Scotland, at least not in the two council areas I rent in. They both rehouse at the end of the two month notice to quit, they do not encourage the tenant wait on the court order.

    Which is very convenient for those living in a Local Authority where vacant properties are available for those who need them. In most areas this is truly not the case: there aren't properties sitting vacant and the majority of LA's don't have enough to satisfy demand. Therefore only those families in imminent danger of becoming homeless can be helped.

    I know that the situation has moved on now but I just wanted to pick up on the highlighted bit from your previous post.

    The council don't have the housing stock to re home them so they push the problems on the landlords. They don't care. Everyone thinks landlords are loaded.

    100% agree.

    I have been in the same situation with a flat (In Bromley) -after that I sold the flat.

    but if you have given them proper notice, and they do hand the keys back when the notice is up and move out, then the tenancy is over and you have your property back.

    The tenants contacted me at the weekend and said they are now moving out to a place with their friends
