My understanding is that under QRs if a DEO is 'requested' for 40% then they will be told where to go, as it is against QRs as if this is enforced then the said person will not be open to the full force of Military Discipline. Say they are sent to DQ's then they don't get paid, how do the CSA take 40% of nothing?0

I don't understand...are you saying that a 40% DER would mean that the NRP 'would not be open to the full force of Military Discipline'..? What difference does that make?

When in DQs you don't get paid, or never did in my time. so a DOE set at 40% will get thrown out end of, as it is unenforceable! Fact of life, and I know the CSA don't like those as they cant get round them!!!0

I still don't know what a DQ is, and surely if the NRP's wage had dropped to nil then he would contact the CSA to tell them, and they would nil assess him for this period? If a 'DQ' is something that just lasts a week or so then the employer would have to be mindful of the NRP's protected earnings anyways, so it's more likely that would be a factor, rather than the MOD telling the CSA where to go.0 -
DQs is Detention Quarters [prison]
QRs is Queens Regulation, the law that runs the forces.
If the person is sent to DQs then the chances of them being able to contact anyone is not good! The CSA will loose the fight!
There is also a limit on the amount that can be taken from a serving persons pay, this is checked if someone is to be 'Charged' under QRs, a report has to be done by the pay office before they can be fined, so a DER or DEO will get in the way of that! This has all be challenged in the Courts and the CSA lost against the MOD!0 -

They may not be able to enforce the 40% arrears rule but meh at the end of the day the debt has still to be paid. I wonder how many squaddies will still be paying child support once their child hits 25
I also thought it was frowned upon for squaddies to have outstanding debt.*SIGH*0 -
They will have all kinds of fun trying to get a charging order on a barrack block or send in the bailiffs, here you go mate take my weapon!!!
The simple fact is that QRs beat the CSA and they bleat about it, end of. They are not all powerful and the system will beat them.0
