carers allowance means tested ??

Thanks for taking the time to read this . I have a little problem Mr DWP have overpayed me for carers allowance by a large tune of dosh and would like me to return it ASAP. I have never knowingly applyed for extra carers allowance . But if i was getting income support or child tax credit at the time the overpayment was made would i have received less of this benefit as i was on CA. (what i am thinking is if say i got £100 I.S and £60 C.A--- If i was only entitled to £40 C.A would i have got £120 I.S)+ every year i filled out a ctc form i had to ring the CA to get a total of amount they paid me . Wouldnt this have been flagged up. I am going to take advice before appeal but i would like to have a more clued up knowledge of my "brain questions first" thanks in advance.

I get about £40 a week IS, plus the CA and CTC. For IS, the DWP add on a carer's premium and then reduce the total amount by the amount you recceive in CA.

You get your CA, and IS deduct this amount from your IS claim then add on a Carers premium.
Two different departments so this is why it has taken so long for this to come to light. It is your job to inform IS of any other income you get.*SIGH*0 -
When you claimed CA, did you notify IS that you had made this claim? If not, then they will ask for you to repay it. If you did, then you won't have to repay it as it will be classed as Official Error. They should have reduced the IS according to the amount of CA that you got.0

We have notified all parties concerned all the way .I have been getting CA from about 1990 in 2000 we were advised and adjusted onto CTC from IS and we received a enhancement of extra carers allowance (we never applied we just thought it was changing from IS to CTC) but my OH has been in receipt of IB since 1989 and i have been getting a CA for her too. Every year filling in our tax year form we always have to phone CA for a yearly figure and have never hidden away any thing when filling in anything. We have been off all means tested benefit since 2007 still receiving CA & OH IB until 2010 when CA stopped as the person who i was getting CA for moved into residential accomadation. In 2010 Mr DWP sent me a overpayment demand for a huge sum with 30 days to respond and pay or appeal i appealed asking for them to tell me where i have applied for extra or enhanced CA and why it took a decade to notice. 14 months later they say as a result of reducing overpayment by about £200 they have acted favorably and wont send to appeal service and i must pay or respond within 30 days . any advice given for me to get my head around this .:cool: hard as nails on the internet . wimp in the real world :cool:0

What do you mean when you say your OH has been getting IB since 1989 and you have been getting CA for her too? You do know you can only claim CA for one person?*SIGH*0 -

I was trying to say that for 10 years filling in my tax forms i have been informed from the CA department that i was getting 2 lots of CA and also declaring 1 IB I know there is no connection and i now know that the enhanced CA was in fact 2 lots . Also is there a time limitation where a claim against you can become or is statue barred as claiming back to 2000 in 2010 is a bit long.(i am sure if i now realize i could have claimed something back in 2000 they would say "tooo late muccka":cool: hard as nails on the internet . wimp in the real world :cool:0

Yes it is thanks for finding it and i appealed and heard nothing until this week (14 months) . I took a session with a solicitor who deals with benefits and he advised me how to write a appeal and once all papers come back then to decide if i need to "employ him to continue the case"back in Feb 2010 . Just a single letter this week saying after recalculating the figures its £200 less so in your favour and not going to send to appeal. seriously £200 represents about 2% of what they want:cool: hard as nails on the internet . wimp in the real world :cool:0 -

Please don't spend any money on a solicitor, I quickly read your next post. Have you been in contact with a welfare rights officer? They are either in the CAB offices or your local council office should have them.*SIGH*0 -
went to CAB last time for help and they were less than usless and as i have too much equity in my house they couldnt even give me a interview for weeks .Although the lady in a CAB 5th closest to my home gave me the details of the solicitors i spoke too.I will try the welfare officers and will do alot of footwork myself. I still really only want to know how i managed to get extra funds without applying for anything different. I will pay the money back if i have done wrong but due to the way the system has treated us over the years (such as when we moved from IS to CTC they said i hadnt filled in 3 council tax forms 3 5 &8 years previous we had to pay in full although i could prove i was on IS at that time).I would rather not.
