Section 75 Advice

I hadn't realised there was such a thing as section 75
About a year ago i bought a Fiat 500 from a dealer but when i purchased this car (using my Egg credit card) i repeatedly asked if the car was quick and good for the motorway to which i was told 'yes'.
I felt quite pressurised into buying this car so put a deposit of about £5000 down on it over the phone that afternoon (close to 5pm)
When i picked the car up i realised that it wasn't fit for purpose (1.2...should have bought a 1.4 but was told there was no need)
To top this off the car has been nothing but trouble...it has been in the garage 4 times sorting out rear sensors and bluetooth...it eats petrol ..it's incredibly sluggish (again would the 1.4 have been better) and i don't feel confident overtaking or pulling out...and to top it all off it always sounds like it's revving (prob why it eats petrol)
Now my question is....as I feel that the car was not fit for purpose, does anyone know if Section 75 would be effective
I have had numerous correspondence back and forth but they are reluctant to take the car back or change it for me to a 1.4 without me paying extra for it...I think this is absolutely unfair...

Why unfair a 1.4 is more expensive than a 1.2 so why should they give you a free swap.
You would have to prove that the car was not fit for purpose according to the Sale of Goods Act to have a chance, and given that the defects you mention are relatively minor I doubt that will happen.
Section 75 won't let you claim purely because you decide that a 1.4 would be quicker, a test drive prior to purchase would have told you that.0 -

I agree. Most of the problems mentioned are very subjective and relate to the choice of car and its engine size. The car doesn't appear to be faulty and the garage hasn't misled you.
Ask them to look at the revving issue and ask what it would cost to exchange it for a bigger engine model.
Otherwise put it down to experience.We need the earth for food, water, and shelter.

Agree with the above - also never, ever buy a car without driving it. Even if you felt it was powerful enough, what if you just couldn't get comfortable in it or worse couldn't even fit properly, the pedals felt awkward etc etc0

Why not ask the garage about the cost to change to a 1.4?0

i did test drive and mentioned that i thought it i wasn't sure it was nippy but she said that it was because we were in a city and it was much better than a mini (which i had said i might buy) and how stupid of me to want a 1.4 when a 1.2 was more than enough
the other thing is that i was willing to pay more for the 1.4 but only the difference between the two cars not the VAT as well (which meant paying the VAT twice)
and i felt pressured as i needed a car for work, she knew this and kept saying that unless i bought the one on the forecourt then i'd have to wait 3 or 4 months and my car that i was trading in would be worth less and it wouldn't be worth waiting and if i didn't give her the card details by 5pm the car would be gone
I think i was probably to trusting and expected a reputable dealer to offer me some advice and not LIE to me...woe betied the next dealer!!0 -
They are a business, they are ment to sell. The fiat 500s are quite nippy , but 1.4 will be quicker and drink more fuel. It maybe how you drive it. The bluetooth faults /sensors would be done under warranty . section 75 wont apply you also left it 1 yearDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
