    But you still have no proof it's the tree. Any decent builder will have noticed the tree and undertaken mitigation to ensure the tree roots didn't cause any problem to the new structure.

    If normal strip foundations were used your builder could be negligent. A pile and ring beam system could have been used, this would enable the roots to continue growing without causing damage as they grow between the piles.
