Rent in advance = last month free?

Hi there, I was wondering if someone can help me.
My fiance and I moved into our rented flat on 12th August 2010 paying a months rent in advance and a deposit.
We are wanting to give a month's notice of leaving on the 12th of this month, does this mean that we do not have to pay rent on the 12th?
Do we get a month rent free (12th May-12th June)? Meaning that we have already paid our last lot of rent on 12th April?
We are on a rolling contract.
Any help would be great

Ok, irrespective of notice periods, deposit deductions etc.:
No, your rent payment on 12th April is for 12th April to 11th May, why should you not need to pay rent for 12th May to 11th June? Where have you gotten this notion from?? You cannot use your deposit in lieu of the last month's rent.
Could you perhaps explain your logic so it is clearer as to why you think this, thanks.0 -
That's the thing, I've confused myself. I'm thinking that because we paid a month's rent in advance when we moved in, this would make our last months rent free?0

You pay your rent in advance for the month that you live there, so the rent you paid on the 12th august covered you to live there till the 11th september, so you will need to pay on the 12th of this month in order to move out on the 11th of next month.0

IF you are leaving on 12th May AND your rent pay date is the 12th of each month, then on 12th April you paid rent to cover the period 12th April till 12th May. When you leave on 12th May you will be up to date with your rent.
If you are leaving on 12th (actually should be 11th!) June, then on 12th May you pay rent as normal to cover 12th May to 11th June.0 -
G_M are you a month behind? If they give notice on the 12th of this month, being the 12th May, they would not be leaving on the 12th May would they, they would be leaving mid-June. I think you are still in April :cool:0

Ah, I get it now, sorry! Thank you for that. I must seem completely stupid, my mind is addled with revision I'm doing for my Uni exams while trying to sort out moving.
We are having to move because the flat we are in at the moment is riddled with rising damp and basically appears to be a building site inside, which we have had to live in for months now as the landlord has not repaired it even partially. Walls are torn down to the brick in places and there are still damp patches. Are we within our rights to withhold the rent payment we would need to pay on the 12th of this month due to the landlord breaching the contract by not undertaking repairs whilst we have lived here? Just wondering if this is legally possible?0 -

Repair issues and the rent being due and payable are completely separate. Why have you not raised this with your landlord before now? Just goes to show that if you tolerate crappy conditions without a whimper there's no incentive for the landlord to get them fixed. They probably will have to now if they want to find new tenants but that won't be any comfort to you.
Was there a full dual-signed inventory when started this tenancy?0 -

We have raised this matter with the landlord repeatedly, we raised it within a month of moving in. We have not tolerated "crappy conditions without a whimper". There was no inventory whatsoever, which I found unusual. I'm actually surprised at the attitudes on this board to be honest, it is quite obvious that I am new here, and only asked for some advice.
Making assumptions when you don't know the background, and a contemptuous attitude is frankly unhelpful.0 -
