Removing my name from mortgage 12 months after split?

In January last year, I split up from my partner at the time and moved away to live on my own and declared myself bankrupt in June. We had a joint mortgage at the time and this was with GMAC.

I have just checked my credit file and found that I am still linked to the mortgage at the property (now under Paratus Amc). I can see that the mortgage is still being paid and up to date, but I appear to still be liable for this even though I have had nothing to do with the house full stop for over a year now.

I have not had any contact with my ex and I don't intend to due to starting my life over. How would I be able to remove my name from the mortgage so that I have no current link to this address?

    You can't - only the lender (or owner of the mortgage) can and I can't see them showing any enthusiasm for waiving the contract that they still have with you.

    Your partner may be able to have this done by the lender (if they and the property can meet the lending criteria alone) but you will both be involved in the process - so contact will be necessary, albeit via solicitors if you wish (bear in mind this costs)!

    Incidentally, you didn't have a joint mortgage "at the time" - you still have one.

    when you went bankrupt did you declare the property and the mortgage to the OR?
    how did they deal with it?

    As joint owner of the property, did you declare the property as an asset (and the mortgage as a liability) to the Official Receiver?

    I did declare this in my bankruptcy form and I was have not been told been anything about the mortgage since - incidentally, though she has been paying the mortgage up to date, she had also declared herself bankrupt in April of this year......
  • In that case there is not the slightest chance that the owner of the mortgage will permit you to be released from the joint and several guarantee.

    was there any equity in the property?
    was an IPO agreed?

    There was hardly any equity in the property.

    I am paying my own payment agreement to my receiver post BR.

    Even with only a little equity the matter or ownership has to be addressed in bankruptcy... did your OH buy the beneficial interest?
    I would suggest you speak to your OR and ask how you get your name removed from the mortgage and deeds.
