Rotary watch guarantee when retailer goes

The retailer is responsible for the refund, not the manufacturer, your ability to get a refund (if not a CC purchase) disappeared with the retailer who sold you the watch.
I would ask Rotary to provide you with a list of all current models they would be willing to swap out cost free to you - then go from there - bear in mind they are the ones who said it has to be swapped, so get them to give you the list, therefore you know they arent going to turn you down...0 -
Rotary have supplied a list of watches. I don't want any of them. Thats my point - i am been forced to accept something i don't want through no fault of my own.

Your only other avenue might be to somehow become a creditor of the defunct retailer.
But as you haven't told us who that retailer is, or how they went out of business, it is difficult to advise whether that is even possible.0 -

I was bought a watch from an authorised Rotary watch dealer. The watch went wrong twice and sent back to Rotary for repair.
It then went wrong again - and Rotary said it was their policy to replace it. This was all in the warranty period
As it was an obsolete model they asked me to choose another.
I have now given them 6 differnt models - all widely available on teh internet in the UK. Rotary have responded by stating they are either obsolete or i have to pay up to £206 extra for the new watch (even though the new watches are available at a multitude of outlets - inc Rotary dealers at less than what i paid for mine)
I have requested a refund. But they appear to be not very helpful and as yet am awaiting a response.
Does anyone no where i stand regards a refund ?

ahh so now it becomes a bit clearer...
all rotary have to do is provide you with a comparable featured watch, they do not have to provide you with one you 'like' and they are certainly not responsible for providing you with a refund - I wouldn't even ask the manufacturer for one, they have received no money directly from you so are not responsibile for refunding you the RETAIL price you paid to the RETAILER not the manufacturer.
From the sounds of it, they have been more than reasonable, especially giving you a list to chose from initially - they do not have to give you one you like, if you want a refund you have to ask the retailer.
If you can only find other watches at a higher price that you like then you have to pay the difference.
I would look at the higher priced watches you like, then find it the cheapest you can online, show rotary the initial watch purchase receipt and offer to pay the difference between the two...otherwise you just have to write off the watch, the manufacturer is not responsbile for a refund...0 -
Disagree with that - buying a watch is a personal decision - a reputable company would do more than the bare minimum and supply a comparably featured watch (ie if it told the time it would suffice).
Rotary may not have received money directly from me - but they have indirectly. Without their end customers they wouldn't be very far.
They didn't give me a list initially - that came after a dozen or so letters/emails. They chose me to pick ones. As i stated earlier, the ones i picked are widely available at a lower price than what was paid for mine.
The manufacturer may not be responsible for a refund - but they are responsible for customer service.
And as i also stated earlier - i can't ask the retailer as they are no longer in businessMark Hughes' blue and white army0 -
They are reputable - if they weren't they wouldn't be dealing with your issue. As it stands they are actually dealing with your issue within the law and within their obligations.
Wheter Rotary ended up with some or none (the retailer may never have paid Rotary's invoice themselves for example).
I guess its got to the point that unless they give you the watch you want you aren't going to be happy...which unfortunately I really don't think they're going to do...0 -
Had issues with a watch costing just under £400. Thought been a reputable company that there shouldn't be an issue. How wrong i was.
I found them obstuctive and unhelpful beyond belief.
£400 down the drain
Subsequently got a loveley Seiko watch. Whilst looking for one following my Rotary debacle, many jewellers i spoke to said this was typical of Rotary aftersales.
