Taking legal action against the CSA

    Clearly not uncomfortable enough for my ex!! He has only every paid £50 per week off some of the arrears for a year (when he never paid a single penny for 5 years) when he was about to go to prison. He was given a suspended sentence. Suspended on the proviso that he pays £50 per week which does NOT include his ongoing maintenance of £73.37 per week which he has never paid!!! He paid the £50 per week towards the arrears, but he was still going into arrears further as he wasn't paying his maintenance!!!! However, after a year, he decided that he didn't want to pay anymore, so he hasn't. He owes me over 25k and this goes up every single week. The CSA solicitors are completely USELESS!!! He should have been back in Court by now as he last made a payment in January, but there is still no date, despite the case being referred to them months ago. He made it clear that he wants nothing to do with his daughter by telling her to her face when she was 12 years old. Fair enough, but he still has a responsibility towards her - he can't just change his mind and not want to be a father any more - this really makes me angry when a parent just changes their mind after being quite happy within the relationship to have the child, and when the relationship breaks down, the child gets shoved aside too! Anyway, he needs the book throwing at him NOW, no more softly softly, because IT DOESN'T WORK!!!!! It is quite clear who needs tougher action and who doesn't it always has been, but the policy makers within CSA are too stupid to realise this and be tough when it is needed. Had they done this in the first place, they wouldn't be in half the mess they are now.

    I don't think they dare throw the book at anyone these days - although if you're lucky they could put his name on a name and shame website...

    It won't help you any unfortunately but it will help the politicians say that the new CSA is working (or will be working)...

    I doubt he will be one of those named and shamed because he won't be on the new system when it's set up as my daughter is nearly 18! By the time it comes in, she will be over the age. hey ho!! Luckily for me (hopefully that is, as my luck never seems to last) as they have 3 charging orders on his house, and his house is currently for sale, when it sells, I shall get my money! However, I am sure he will find some way round it.

    Your luck has to change sometime - let's hope that the sell of the house gets you the money you're owed...

    Thank you very much. It will be very useful - my daughter is to go to uni next year and so it will help pay for accommodation or something else equally important. Shame he (her father) doesn't give a damn!
  • I am in desperate need of help, My ex husband owes me £2,500 and the CSA have dragged their heels for nearly 2years with this. I now find out it has gone to bailiffs who after another 3months managed to get an agreed amount of £25 per week out of him. This is just never going to happen, i know the man inside out he will pay for a week or two and the just stop. He gave up his job so he didnt have to pay me and his father died last year and he was a lottery winner so i know for a fact thats what he is living on with his new wife and their 2 cars and holidays to costa rica ( we get gloating postcards -nice). I feel like I am just banging my head against a brick wall and nobody is listening. How is this fair? Why hasnt he been made to sell his assets if he cant pay or why cant CSA look into his bank account? How can the bailiffs have the authority to agree to such a pitiful amount without running it past me?
    I would like to take CSA to court but i wouldnt know where to start, even when i spoke to my solicitor about it she said that most solicitors wont touch CSA.

    Can anybody give me some advise please???

    YOu can only go through the complaints procedure - complain loudly via your MP, go to the top, then go to ICE and the Parliamentary Ombudsman.
