Ordered a book off eBay, instead received a pack of pens

LOL, title says it all. can I do the following:

- open a PayPal dispute
- purchase the same item off another quicker, better seller
- escalate the dispute to a claim if the refund is not issued
- get a refund for item being completely different to as described

    Why not be less dramatic and email the seller stating that you received the wrong item. Chances are they sent you the wrong one by accident, accidents happen.
    Also, there have been 3 bank holidays in a row and post is slow atm..It may have been posted the day you purchased, again..ask the seller.
    THEN depending on the sellers reply (please give them longer than a episode of Jezza as its a holiday weekend again!) either sort it with the seller or open a dispute on ebay/paypal.
    She has the loaded handbag of someone who camps out and seldom goes home, or who imagines life must be full of emergencies..

    I have already sent him a message, like I said though, I just can't be assed with the awful sellers on eBay lately, I've never had any problems in the past but now they are just full of mistakes like this. He will probably just fob me off with sending the item back or something, which just means more waiting for me and more of my time. Is it really too much to ask for someone to just send the damn item you bought to the damn address you ask them to?

    Is there any more immediate action I can take, such as a visa chargeback, as I really can't be bothered waiting around for another couple of days for him to reply and then another couple of weeks before another item finally crawls its way to me.

    I will edit the OP as I just had an idea.

    PS as for the bit in bold - you can see when the item was dispatched on eBay :money:

    Not unless you paid more than £100 (and I don't think you can chargeback when you have protection via paypal).

    Really? So more hassle for me, the buyer? Would I have to pay for that? Why does everything seem to screw over the consumer when it comes to online trading?


    What would you guys recommend I do? As proven, this seller is incompetent and takes a huge amount of time to dispatch the item, and given that the item took around 4x the estimated time to reach me it wouldn't surprise me if he was dispatching directly from China or somewhere. I just can't be bothered with him/her and would rather now use a better trader who can actually get the item to me within a few days.

    Yeah, the MSE eBay board does have an ultra-clique of sellers who go out of their way to try and defend their fellow sellers. I'm a strong advocate of buyer rights though so we clash.

    The seller may tell you to keep the item (pens) and will dispatch a book to you. If they no longer have the book (sent to the pens buyer) then they should refund you. As for sending the pens back, personally I would send back large letter 1st class recorded (I imagine the book/pens to be worth £10<?) and if made to return the pens at my own cost then I would hit some stars and a big neg.
    I once mixed up orders and paypal'd them the money to return items back to me and a bit extra for a sorry..I then re-sent them back to the proper buyers. Everyone was happy.
    As for dispatch that only shows as dispatched if you manually change it/pay postage with paypal. I have in the past sent via post office and forgot to change it on ebay..thus the buyer can have their item but on ebay it doesnt show as dispatched. Was there a post mark that was dated on the item? If paid by paypal what was the post by date?

    :rotfl: What the f- I just looked on the parcel and the stamp says it was dispatched on the 26th! I ordered it about about 2 weeks ago and eBay says it was dispatched on the 18th. So has he just completely lied about dispatching it? This trade has FAIL written all over it and unless the seller makes me VERY happy this lying idiot is getting a big fat neg..
