Yes they have a choice, but I am not sure if they can do as you say, or if they want to have it legally, then they have to go to CSA. I'll see if I can find out.0

I thought if the PWC is a private case then you could set up a SO clearly marked For Child Maintenance. I wouldn't pay by cheque either if the PWC starts a claim with the CSA and the NRP continues to pay them direct when being assessed as it takes so long for the assessment to come through, hence arrears building up.
The PWC could then try it on stating it wasn't for child maintenance, thus the NRP would be paying twice.
The PWC could also use the Children's Act 1989, Schedule 1, especially if NRP is a high earner and/or go for a lump sum.0
