    I suspect that the third-party present at the signature of that guarantee was the car-salesman, not a solicitor

    As this is a regulated loan (the OP's mother's liability as guarantor would have been regulated, not necessarily the lease), it would have to have been signed on the dealer's premises.

    ok. i think i have a plan. someone pointed out to me, how did they even let my mum be a guarantor anyway, she never showed them any wage slips etc. so they must have gone on information given to them by my brother. his business cant have been doing well because it went under, and even if it was, if anyone saw my mums part in it for real, they would know that she recieved no annual income from the business and she only works part time in a shop, the monthly repayments were over £600, thats her whole months wage! nobody in their right mind given the real information would let her be a guarantor. i dont think they should of even been given the car in the first place. this reminds me of irresponsible lending. also someone was reading me a consumer act of somesort (ive got a print out somewhere) where it says about pressure being put upon the person (sorry cant use correct terms as i gave the print out to my parents to read) which would come under what somebody also previously said about undue influence. i thinks he has a good case. there is already evidence that my mum was a victim of fraud, as a previous company wanted money from her and she hadnt signed anything, they then asked her for her to produce her signature so many times and tehy sent it away to be looked at. she never heard anything again so my mum presumed my brother had sorted it out. however, even if he did, to me that says guilt! and im sure in any court in the land, if tehy looked into his business would find some very illegal things, surely nobody can do anything to my mum when there is reasonable doubt as to foul play on my brothers part.

    i think if its gone at from this angle then maybe she has a case. i think she is goingt o look at those no win no fee places to go for help

    i must add, my brother didnt even make one payment on the car, he never even tried to pay it monthly so he must have known he couldnt. depsite lying to my mum and saying he was paying it. to me that also is unbelievable, he was given a 34 grand car when he knew he couldnt pay for it!!!
