Hi All, I got divorced back in 2002 (bare with me this is complicated!) my ex and I had a private agreement, he retained our old property, I retained our new one, but he retained the garage and an acre and half of land on my property. We didn't use lawyers when we were divorced agreed the settlement between ourselves and submitted the paperwork to the court etc, all done and dusted.
THis is where it gets complicated! the court had allowed our private settlement to go through (we had had a prenup but he had disregarded it and gave me more through his own choice). In 2009 he got remarried and his wife turned him against me (we had been good friends since then) I was worried as he still owned the garage and land on my land so offered to buy it at market value through a morgage, he said OK then backed down and admitted he had done it to be nasty! and never intended on selling it to me (by then I'd had estate agents out to value etc) Because of how the property was laid out I was very concerned that he could throw a real spanner in the works if I wanted to sell. Spoke to lawyer and within 15 mins ex was signing garage and small bit of land over (otherwise go to court to have prebup overturned etc and go for full half of everything) later admitted to me he was glad the garage etc was off his hands as he had caused some planning issues with it (I've now sorted). Now (more complicated still!) I later found out (baring in mind I had never bought or sold a house and didn't have a clue about anything) that he had never done the land transer to my sole name in 2002. Found this out when transer needed doing for the garage etc in 2009 so he then did the whole property as one transfer (so was never a title deed in his sole name for garage, just whole property joint names, then whole lot signed solely to me. Now, yes it was all done as one transfer and was divorce settlement but I did not actually get back legally (remember original divorce settlement AFTER prenup that passed by court said garage and small amount of land to him) so even though the transfer for my divorce settlement was done in 2009 I LEGALLY through divorce recieved part of it in 2002 and part in 2009, 7 years after divorce. Therefore looking back on it should I have declared on my tax credits renewal that I had gained property?? (as in the garage) as surely this falls into divorce settlement and I haven't gained as he had one property I had the other? Just wanted to double check being as part of it was handed over to me 7 years after divorce. Sorry its so long and complicated!!
