My neighbours IVA

After mine was accepted I was chatting to my neighbour about her IVA, she is in the process and her creditors meeting is next week, she told me she has a bank account in her sons name (he is 6) and is getting her CSA money paid into that and has told the IVA commpany she doesn't get any! She says she opened the account while she was looking into the IVA as she didn't want to "not have any money"
She has it paid into his account and then withdraws it as she wants it.
Is this legal! I am worried she will get found out, not that it should be any of my worry, but surely she would be better off declaring it?
You will all probably tell me to mind my own business, but this seems hardly fair to others who have been very honest with their IVA companies.

Hi. Personally I would not get involved in her little deception ( for that is what it is). If she does get caught out ( and it is entirely possible) then she could be deemed to be in breach of her IVA and will be back to square one.
It could be argued that the CSA money is her son's anyway. But to be dishonest with the company offering her a way out of debt is not the best way to start a new life.0 -

I agree with Foggy in that I would just leave them to get on with it.
These type of things often have a way of coming back to bite you on the butt and especially when you least expect it. :eek:0 -
I wouldn't get involved, things will eventually catch up with her.
I'm surprised the bank allow her to withdraw from the account. Also I'd be surprised if her IP doesn't ask her if she gets CSA and would probably insist she goes through the courts to get it if she tells them she has no other income.Cabot (0%) left to pay £2455 let the overpayments commence!0 -
I think the Inland Revenue might have some way of knowing she gets CSA, and the IVA company may well find out using whatever contacts they have. Just let her get on with it - she will have the stress of maintaining the deception for five years if she doesn't get found out sooner.One life - your life - live it!0
