VIC check fail come back on seller?

I recently and stupidly made a mistake buying a second hand car and didnt realise it was a cat c write off until I had paid for it and got it home.

Whilst im not particularly fussed about the cat c write off - its a relatively cheap car, it hadnt had its vic check and as such I wont get issued a V5 until I put it through one.

VOSA seem to think that hardly any cars fail the vic check these days, but I wondered what if any comeback I have on the seller if it should fail and turn out to be a ringer or something?

I understand its a legal thing then probably involving the police, but my worry is that I could end up losing the car and my money.

When i bought it the seller did me a full receipt clearly stating that he was the legal owner of the car, so does that mean I could take him to court for the money?

Hopefully it'll pass the vic check and all will be well, but im worrying :-)

any help or comments would be much appreciated to put my mind at some sort of ease until may 9 when its booked in!

    You can take him to court but whether you actually get any money back is another thing.

    You cannot take what he does not have. It will cost you to take him to court also.

    Course now ive been poking around a little more ive found he seems to sell a lot of cars with a varying range of reasons for selling - clearly all made up storys - too small, cant be bothered to fix etc.. etc..

    I'm tempted to HPI one of his other cars to see if they are all cat c/d's

    Hopefully it'll pass the vic check and i'll have got away with being careless rather than end up carless!
    You can take him to court but whether you actually get any money back is another thing.

    You cannot take what he does not have. It will cost you to take him to court also.

    Is he posing as a private seller, if so shop him to TS & HMRC , you might not get your money back but it will give you a warm glow inside ;)

    I'll second this, it'll stop him being a [EMAIL="pr@t"]pr@t[/EMAIL] to someone else who's a little 'green' about buying a second hand motor.

  • Why dont you contact the seller first and see what he has to say for himself, as you know the car will be worth less if you decide to sell it on than a car of the same that isant a cat c. You could try asking him for a part refund if your happy with the car?
  • I asked him to at least refund the vic check fee which he agreed to do but so far no sign of the money.
    Will see if the car passes the vic check and take it from there but will certainly look to report him in some way, as mentioned it's not on to try to rip unsuspecting and nieve people off.
    All his cars have the same "story" as to why he is selling them which is clearly a load of rubbish.
