Faulty DVD

For my birthday I was given a DVD box set. On watching it I realised that the third disk was scratched, so it cannot be watched.
It was originally from Amazon, bought by a relative, from our wishlist. Amazon confirm this.
However they say that they will not replace the disk, as we have opened the disk. I pointed out that we would not know it was faulty until we opened it.
We want this DVD, and I said I would be very happy to have just the fauty disk returned, (the others in the box set are fine), but they refuse to help.
How can a company sell faulty items and not accept any responsibility for them?
