Car insurance claim - other party hasnt done a statement

I had a car accident 11 weeks ago, which i believe was not my fault. I did a lengthy statement straight away and ook lots of photos which i think support my argument.
I had a call from the third partys insurer the day after asking me if i could confirm his version of events - which quite frankly didnt make sense.
however its now 11 weeks later and despite being chased he has not submitted a statement of his version of events. my insurers have now sent his insurer a 14 day notice, asking them to pay up or we will proceed to court.
i cant understand why he wouldnt do a statement. but has anyone any experience of this, or knowledge of what might happen now and if it were to go to court.

Don't deal with the third party insurance company - refer them on to your own insurers.0
