I think that yes, the court can force him to either part with it, or buy you out.

He can be as difficult as he wants to be of course - if you aren't paying the mortgage is there a reason why you want it sold? Presumably to release equity? As long as your solicitor is up to speed you should be fine I'm sure.
  • Hi,
    I'm in a simular situation
Cant post links yet but just search under my user name. The best advise if legal advise tho
Be prepared to be in for the long haul tho. My costs (or his if he pay's them!) are currently up to £3k with 2 court visits
    Good Luck

Even if the courts force your ex to agree to a sale, who is going to buy it with a tennant who probably wont want to move as he is your ex's best friend?

Any buy-to-let landlord would jump at the chance of buying a rental property with an existing tenant; saves all those agency fees and the time wasted in finding a tenant.

Hi I am also having enormous problems as I am trying to sell my house as I am struggling to pay the mortgage since my husband and I separated. The house has been on the market for 18 months but the trouble is it is too highly priced but my soon to be ex husband refuses to lower the market price to the price advised by the estate agents so that it will actually sell. I am paying the mortgage on my own and struggling to do this with other debts I have as well. I am taking him to court to try and get this resolved but I have now just been told that my final hearing date isn't until 5 April which means I have another 3 months to pay before I get a decision and even after then I still have to sell the house. Any advice anybody can give me will be gratefully received. :(

This may have been better as a new thread as the other one is so old.

What has the solicitor said about it? Is there any way your solicitors can negotiate to avoid court and to get everything sorted quicker?

My ex told me every story under the son when we split. Thankfully I didn't have to take him to court but it was extremely stressful. Do you live in the house or could you to save some money until the court date?

You really need to start a new thread. It gets a bit confusing when people start answering a two year old thread and yours at the same time.

When you have done that, don't forget to delete your post here.
