Hi

In feb i left my job. It was a future for jobs placement-min wage /25 ph.
In december a friend asked to see my contrac for the date i left, and noticed the contract had the wrong end date, feb instead of march.
I asked the employer about this and if it would be changed. I was told no and to just carry on and i should have checked i eariler-it was my fault it was wrong as i had not checked and i will work til march or ill be sanctioned.

Bit of a back story:Before this the employer wasnt great regarding a racist issue and i was going to be called in for it(i complained someone had made a comment and was told i was over sensitive.)They were only helpful when i contacted the job centre manager. They were not trust worthy and abusive, so i couldnt trust them to honour anything they say.

So i said unless i get a renewed contract i will leave on the date shown. I was told "ill make sure you wont get jsa". I couldnt trust them to stick to march as in theory they wouldnt have to pay me.

So the date came and went and i left on the date. When it came to claiming jsa she told them i left of my own accord and the contract said until march. (when in black and white it said feb)

The job centre manager couldnt belive her cheek as he had seen the contract and her note saying she is ok with me leaving.

So ive had to wait 2 months for an outcome. Yes i was paid. But surely the employer should get a warning, theyve wasted time for the jsa and ive been worrying the whole time.

Thankfully everything is ok, but if they did this to other people who maybe dont keep everything it could have been diffrent.

Surely they should get in trouble for lying.
Rant over...

I've read your post twice and it makes no sense I'm afraid. When you've finished ranting perhaps you could try again to communicate what you want to say.

I'm struggling to understand, but whether you left in February or March when there was a job for you, you left of your own accord so would face sanctions either way. (?)

According to OP s/he was supposed to have finished in march but the contract said february so i would say and quite rightly the OP left which was on the contract not what was verbally told her. So i imagine no sanction would be applicable.

But they refused to continue to work.

I asked for a new contract, and they refused. I asked to keep working but i needed a new contract with the correct dates. I couldnt be sure they would honour anything.i woud have worked he dates

If i lied id be in trouble,an employer lies and all is forgotten.I followed my conract and even asked for a new one. It was in black and white- the dates were shown and she lied saying they didnt say that and wouldnt give me a new contract.Employers can do anything these days
  • I would consider deleting that first post and rewriting it - I can't understand most of it; its unintelligible.

Even if you had not had a contract covering the month of March, you would have been working under the same terms as before and received an additional month's pay, which presumably would have been more money in your pocket than JSA. Why was an amended contract so important to you?

Although the OP is a little confusing, it's clear to me that her contract said his/her post expired in Feb. S/he asked for a new contract to cover March, and the employer wouldn't issue one. S/he felt that if she worked March, s/he might not be paid - sounds totally reasonable to me NOT to work on this basis - and JCP obviously agree with this view, since they have now paid up.

I agree that employers sometimes get away with outrageous behaviour for which employees would be disciplined. In this case I think a fine for 'wasting JCP time' would be a good idea, some of which should be passed back to the OP for the stress and worry it caused. But then, I would like to live in an ideal society!
Ex board guide. Signature now changed (if you know, you know).

Yes-this is what happened. I think its unfair for employers to be able to mess people around.
  • The machinery of capitalism is oiled with the blood of the workers, I'm afraid.
