Card details stolen -How does it work?

Hi all

I have a Barclaycard that I fully cleared the balance on a few weeks back.

I just phoned up to double check it was all cleared and theres 4 transactions on my account that add up to nearly £1200!!

Ive called them and stopped my card but the dispute team tell me I have to wait untill they hit my account as they are still pending but "approved"

Am I covered automatically to get this cleared???

  • As long as they were not made by you, and this can be proved then you will not have to pay for these transactions.

    Please continue to make at least the minimum payments during the investigation though till at least its sorted out.

    They should refund them upon seeing them but this can take time, in the mean time just have the direct debit for min payment kept on that way your bases are covered.

    As long as they were not made by you, and this can be proved then you will not have to pay for these transactions.

    Legally, this is incorrect - the card holder has to prove nothing ! The card issuer has to prove that the card holder DID make the transactions - a totally different matter.

  • When a company asks for the money-the CC says yes or no. If they say yes, the funds are reserved for them and it's up to their bank whether they claim it and it 'posts' on to your account. This normally takes around 5 working days. If it is not claimed the funds dissapear back into your account as if it never happened.

    So you currently have 4 pending transactions. There are no guarantees that they will post on to your card. They can't stop transactions and can't dispute temp transactions either.

    If it does post, then the disputes team will help you investigate. Best thing to do is contact the merchants and say that you don't recognise the charges and that you are after some more information. If they tell you they are in some one else's name and address then you can go straight to the fraud department.

    The disputes team will look into how the transaction was made. It could be done over the telephone or the internet. Therefore it could be a keying error-someone may have a similar card number to you.

    Don't panic-your card will help you.

    Keep an eye on your account and if they post-go from there.

    Yep. For completeness the two exceptions to this are gross negligence or fraud by the cardholder. NB it is "gross" negligence, not mere negligence.

    So the CC must prove that the cardholder made the transaction or that either of the exceptions apply.

    So if I give my card details to another person and they use these details I'm not liable as I didn't make the transactions...just asking as I need some new furniture and would be a way to get it free?...I'm joking, but do you see my point?

    It would be fraud. So you would be liable. A less likely analysis is that they would be acting as your agent - so again you would be liable because "you" would be making the purchase.

    Thanks for the replies.

    I have since found out that it was my pay pal account that had been hacked and they were pulling money from my credit card. I had some strange emails from pay pal saying my account was restricted ect so I logged in to find I had over £500 pay pal balance!!! I have stopped the card with barclays and have spoken to paypal who assure me that all will be reversed. I hope.
