Sample letters to request a copy of credit agreement?

For some months now, I have been getting letters off Moorcroft Debt recovery for a debt I have no knowledge off. I have in a kind way asked for further information, but so far, they haven't provided me with anything, other than harrassing letters every week and now they are threatening litigation.

A friend has told me about this site and that there may be formal letters on here about requesting credit agreements, but more official and giving days notice, etc.

Could someone possibly help me or know what I am on about?!

    Hi Deb

    If its not your debt then I wouldn't send a CCA request. Presumably you don't even know what type of debt it is and whether its covered by a consumer credit agreement? Not all debts are.
    What have you actually done so far? have you written to them at all? First thing I would do would be to send the prove it letter - http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2

    If they send you anything is response to that then it may be the time to send further requests.

  • Hi Tixy. I called them when I first got a letter, out of the blue, in November 2010 and told them I had no initial knowledge of the debt, its for an Aqua credit card. They confirmed my personal details and they do match. At that point, I asked them to send me a copy of the credit agreement and any other information for this debt. Its certainly not a cop-out and if it is genuine, and they can provide me with further details, then I hold my hands up and will pay the debt.

    Since then, they haven't provided anything and just keep sending me demanding letters to which I have asked in writing about 3 times for more information.

    grrr, thats why I think I need to send them a more demanding letter back.

    I wouldn't speak to them on the phone at all. I would still suggest you start with the prove it letter (send recorded) but if you have already sent similar letter and as you know its a credit card could send the CCA request (with a £1 fee) - there is a template below

    We understand that under the Consumer Credit Act 1974 [sections 77-79], we are entitled to receive a copy of any credit agreement and a statement of account on request. We enclose a payment of £1 which represents the fee payable under the Consumer Credit Act 1974.
    We understand a copy of any credit agreement along with a statement of account should be supplied within 12 working days.
    We understand that under the Consumer Credit Act 1974 creditors are unable to enforce an agreement if they fail to comply with the request for a copy of the agreement and statement of account under these sections of the Act.

    We look forward to hearing from you.

  • Sorry to tag on to your post but... Tixy, after sending that letter above, if they don't respond within the 12+2 days, which letter do you then send? Can't seem to find it and I've been told that the letters have changed recently? Many thanks!

    Are they still harrassing you for payment Deb or have they gone quiet now? If they have gone quiet then I would just leave things as they are.

    Hi, no, they are still harrassing me. I had a letter off them the end of last week stating impending court, etc but I know they have had my original request for a CCA cos I sent it recorded delivery and they signed for it!

    This is why I am after a copy of the next letter, I know there is one on here somewhere!
