Hi all,
..I find my self being made redundant via "liquidation". I had (have) a 12 month notice claus in my contract, (ie the company have to give me 12 months, and likewise I had to give the Company 12 months notice). As the Company is being liquidated do I have a claim against the liquidateor for 12 months pay?....is it worth persuing? I know the company has virtually no creditors, and approx £500k in the bank...
Thanks for any advise

Has the liquidator written to you yet? Have you been given a termination date?0

...we have not been given a termination date yet. It is a bit "odd", but the business has been trading "solvently", but will cease to trade by end of the month as all the work has now gone. A liquidator has been appointed but we have been advised that the business will not be signed over to him until early May. I assume that if the current owner sends out the redundancy notices then he will be laible for the costs?, so I assume that we will have to wait until the liquidator is appointed, and they will then send out the notices....."It's everybody's fault but mine...."0

If the company is actually solvent (which is what you have suggested earlier), then it will be the business that has to pay your redundancy and notice and holiday pay.0 -
Hi and thanks for the input. Whilst the business is solvent at the moment, there will be insufficient funds to pay the redundancies + the Liquidator..ie the business will be liquidated, so we have been advsie that all redundancy payments will be met by the governement....."It's everybody's fault but mine...."0
