Egg registered default without my knowledge

    Make sure to claim for compensation - you are entitled to it - and plenty.

    They have committed no only breached their own terms and their data protection act but they have also comitted an act of "Defamation of Character", which can cause untold financial loss - you may have a balance on your Egg card or another card which you can't get 0% offer on due to their breaches. Etc etc. This is definite and quantifiable financial loss.

    You can't get a default for being a BR back in 05, only if you stop paying and ignore them.

    I would take them to the cleaners.

    Thanks again for all your comments, info and support.
    The advisor did call me back today for an update.
    He advised me that it had been passed to another team to investigate and that, once checked, would arrange to have the default removed but it may take 'about a month'.

    I tried to get him to explain the reason they had issued the default but he couldn't give me an answer. I put it to him that it was as if I had just been made bankrupt and they were verifying this. He told me they needed to check with my insolvencey practitioner!

    I find it all very strange, particularly that they seem to have no explanation themselves as to ehy they have raised this default. Although this guy was sympathetic to my predicament, I dont feel I can wait for him to get back to me 'by the 9th or 10th of May' as he promised. I think I will get those letters out asap and ensure the matter is dealt with swiftly.

    In your formal complaint mention the 15% discount you missed out on, this will enable you to quantify the damage done by this default

    There will be system notes relating to the default that will explain why it's there. They probably won't tell you what these say though! Even if you do a Subject Access Request, they don't disclose everything, even if required to by law

    Appreciate your comments Jon-Boy75. Still find it hard to believe that they cannot tell me why they have raised a default even though my account has been paid on time since opening.

    Although they have not issued a statement or requested a DD fromk my bank for April, do you think it a good Idea to make a manual Payment?
    I asked the advisor this today and he said 'If you want to'. It all seems vert odd.

    I would make the manual payment

    you aren't disputing the debt exists, only Egg's behaviour

    keep up your side of the 'contract' and it will make your case much stronger.

    I agree, I would make a manual payment. I would also use Rectel or some other service to record all calls I make to them. Or you can purchase a cheap dictaphone to do this (I use an Olympus one).

    Also, keep a diary of phone calls made and received, detailing date, time, who you spoke to and what was said.

    This is such good advice and really applies to any situation where something has gone wrong.

    So often you think you are just one or two calls away from something being sorted and formal complaints/compensation is far from your mind. Then as time goes on you regret not keeping a proper record.
