                    Hello all,
I'd like a bit of advice...when I 1st heard about PPI reclaiming I asked a claims company to look into one case for me with CITI bank sometime ago now. (I have learnt my lesson and realised I can do it myself and have done so and won on other claims )
)
Luckily I have been given a bit of a reprieve. The claims company wrote to me today and said that CITI were 'not acting reasonably in this case and no reasonable offers were going to be made. '
The are recommending that I go to the FOS using them, I'm obviously not going to use them to go to the FOS for me as it is straight forward and I can do it myself.
My question is this - Am I within my rights to ask the claims company for copies of all correspondance between themselves and CITI so that I can include them in my claim to the FOS? My belief is that under the DPA I am entitled to copies of letters that involve me ?
Any advice would be very gratefully received!

 Hopefully someone will be along who may know the answer to this, and I believe you can pull out at anytime and ask them to return any paperwork you have sent, and if there was no success, as I take it its on a no win no fee basis?
 However, because the claims company already started the case, although it failed, does it say anything that the FOS is also part of the next procedure on the conditions of the paperwork that you might have signed with the company?The one and only "Dizzy Di" 0 0

            Hi thanks for replying. Yes it was a no win no fee job and luckily as they have not resolved the issue it's back with me unless I specifically ask them to take it to the FOS which I won't be doing. I'll do it myself.
 It's quite lucky as they charge a fee if you pull out whilst they are still corresponding with the company but the FOS procedure isn't part of it.0

            You could phone them and ask for the info they have on your case.
 I am not sure, but i would have thought they would do that anyway?.0

            If you complete the FOS form and submit it then FOS will write to the firm who will provide it with its documentation anyway.
 Are you sure you actually had a PPI policy at all, though - DunstonH says he knows of plenty of cases where the policy did not exist - or was sold by somebody other than the lender.0

 I helped a relatively new mortgage adviser who lives around the corner from me last year who got his first complaint. It was a MPPI complaint and there was no MPPI recommended or sold. It was a Belmont Thornton try-it-on template letter listing a whole load of BS reasons why it was mis-sold. Anyway, when speaking to the network, they said that around one third of the complaints they are getting at the moment do not have the product.
 There is also a complaints handler on this board who deals with car finance and they have said that around half the complaints they are getting dont have PPI.I am an Independent Financial Adviser (IFA).  Sounds to me like there's a breakdown of communication somewhere between Citi and the CMC, so Citi may not have all the documentation you need.
 I would suggest asking the CMC nicely for all the correspondence you seek. If they are not forthcoming, send 'em a SAR and away you go!

 The complainant was lucky it was you helping the mortgage adviser and not me - I would have thrown the Fraud Act at him as well as the ambulance chaser.
 I have no problem with genuine complaints but claiming for something you know you never had is fraud.0
