I had this question posted on the consumer rights and it was suggested to post here as well, but thanks for the suggestion. The dealer has told me they can't cancel the car but will take delivery of it and sell to someone else. I agree with Altarf they have 4 months to re-sell the car and take another deposit from someone else before it appears on the forecourt and given the one that was there when we went for a test drive sold within days of arriving (so we werre told) I don't think they are worrid about selling the car. I would discuss a partial refund with them but can't get anyone who can authorise that to talk to me.

I'd hardly call paying the suppliers price on a brand new car specifically specced to a customers requirements a negligible cost.
And for those saying its easy to sell, you have to find a customer who wants the same spec, colour and add ons. If a customer ordered a lime green car, you may have a problem trying to shift it.0 -

I posted a little while back on this forum, I too bought a new car with Skoda UK, delivery date was pushed back from 3/4months, to 6 months to unknown. I asked for advice here and in other places. I was told the dealer could retain 'reasonable' incurred costs from the deposit. In the end the dealer was more than happy to return my full deposit.
I was surprised and felt a little sorry for the dealer as they are losing out through no fault of their own, Skoda seem to be focussing their new build dates to other, more attractive markets!0 -
If there was a defined delivery schedule or date on the initial order then the OP is entitled to cancel.
Though I wouldn't be surprised if the car dealers have got wind of this and leave such details open ended.
Many people got deposits back from Internet Brokers a few years ago using this clause, but only beause they had insisted on listing the expected time of delivery.
Apparently Skoda and VW are some of the worst for having huge lead times.
I believe even the Police have had to wait longer the normal, and the fact that one of the Octavia Scout demo car we were gioven by Skoda UK was Gold might tell you a few things about getting new cars produced.
I have been told that it is just manufacturers trying to reduce costs, only make it if you have sold it or it is in a psec that sells quickly.
Hence the Police have had to wait a little, but due to the specs all being the same they are easier to plan for.
Apparently if the LAS goes for Skodas we will get them fairly quickly as they are all the same spec.
I wouldn't like to think how long we would have to wait if we wanted Factory options, but 6 months seem common at the moment.0 -

Thanks to all for the responses theres plenty there for me to look through and talk to the dealer about, although I think this may come down to how each indiviual dealer deals with the situation. The deposit was £500, the car was a superb elegance estate and the dealer tells me there was a problem getting supply of a part needed, which is why no build date.0
