Driving licence revoked - what happens

This person was stopped by the police for speeding. He was driving his diabetic girlfriend's car at the time, and he was driving because she she was having a hypo. He was under the impression that under his own insurance policy (for his motorbike) he was covered to drive the car. Evidently, he wasn't.

I *think* he said that he was taken to court and given 6 points on his licence and a £450 fine, which he has agreed to pay at £12 a week.

In the meantime, the girlfriend has had a baby. Things were traumatic - emergency c-section, and the baby spending a couple of weeks in the neonatal intensive care unit, touch and go at one point - and he didn't get round to sending his licence off to have the points added.

Today, he has received a letter from Swansea, telling him that as of 19th April, his licence has been revoked, due to him not returning it.

What exactly does this mean - how long does this revocation last? Can he just send the licence off now (as he seems to think he can) or will he have to resit a driving test? Or what?

    There's no excuse for taking literally two minutes to pop a licence in an envelope and dropping it in a post box on the way to some shops.


    I may be wrong and I hope someone will correct me but he should be able to apply to have his licence reinstated without having to take a re-test, provided he returns his licence. The revocation is just a measure to make it illegal for him to drive until the points have been added to the counterpart. If he has had his licence for less than two years then he may be subjected to the new drivers act and if that's the case he would esentially be banned and have to resit the test?


    Someone with more knowledge on the subject will no doubt be along shortly to correct me.

    OK, you are given 12 months to return a driving licence for points to be added so he has sat on this since Apr last year. First thing is to reapply for a licence. Then contact DVLA and explain the circs. They will generally update his record so that he can continue driving. Once they receive his application they will add the 3 points and issue it to him. I assume he will have 9 points on his licence so he will have to drive carefully for the 3 years from the date of the first offence. If he drives without applying for his licence then if stopped, he could have his car seized and have an extra points, which will disqualify him for 6 months. Tell him to ring on Tuesday to get it sorted. Oh, his insurance may not be valid as well as he has'nt, at this time, a current driving licence.

    His insurance will defo not be valid if he doesnt have a license. Meaning more points 6-8, meaning long ban, big fine, car seized, and if not reclaimed within 14 days, it will be crushed.

    Driving illegaly is bad. Continuing to do so is very bad, you quickly find yourself in a situation of increasing penalties to the point where its going to take many years before you can drive legally.

    Meanwhile you will have a nice record on the Police National Computer and the old bill will jump on you any chance they get as uninsured drivers are statisically far more likely to be involved in more sinister forms of criminality.

    NO record he has not been convicted. there will be a flag marker against his name with the dvla. why people belive this jargon of oh he has a license taken off him he has a record is beyod me.
    also if he rives whilst on revokation he risks losing the family vehicle witch with a child he may not want to do, also if its his partners car she can be done for permitting him to drive it. it justs costs money and hardship alround so best tell him sort and drive whn he gets his license through the post.

    His license was revoked on 19th April 2011, so If he has not driven a vehicle since then, no offense has been committed (it is not illegal to own a car and insure it without a license, so long as it is not driven on the public highway).

    All DVLA can do is give him 3 extra points for not getting his license back to them on time (or, he could try the old 'I did send it back, in June 2010, are you sure you did not receive it?' trick (worked for my neighbour, as DVLA do not require you to send it Recorded Delivery, then it 'got lost in the post, didn't it?')).

    Worst case scenario, he is off the road for a couple of weeks whilst he applies for a replacement license (as the old one went missing in the post in June last year when he got round to sending it back)

    Policies usually say 'providing the driver holds or HAS HELD a licence and is not disqualified for holding or obtaining one'. Revocation is not disqualification. An insurance company may argue about the level of cover but statutory third party cover still apples.

    Bumping this thread because I have a similar question.
    My son got some points and neglected to send in his licence - because he has lost it. Now it's been revoked -- so he has to send in EVERYTHING again, photo, proof of identity, and all? I thought they kept a copy of the photo at Swansea???

    So what is it you're asking?

    What did you expect the DVLA to do when he didn't send his licence back?

    Get your son to re apply and then start driving again.

    Obviously, that's what he's going to do. I am just astounded that instead of simply making him apply for a new licence -- which is fine with me -- they make him send in a new photo, prove his identity and everything - even though they have records of who he is, and a photo.
    It's just being deliberately ... snotty. I was asking to see if I had misread the information somehow.

    Well they don't revoke your licence for 12 months so if he had his act in order it wouldn't have come to this.;)
