is your OH in a 'union?
My union told me 'it is an illegigal deduction to withhold salary' once work had been done.
Get your OH to quote that to them, and they will find him his salary. Acas will also tell you the same.

hes not with a union. he only started 2 weeks ago. we werent expecting a big pay packet this month anyway but even what hes earnt so far we desperately need.

im still seething. i hope perhaps charlies birth certificate and the 20 odd pages i printed off last night from an employment law website will help.

Unfortunately we Brits, seem to now have to prove who we are to all & sundry.
I know there is ID fraud, theft, illegal workers, but sometimes it's like you have to prove you exist, prove you are British & have lived here for last 30-40 years.
If you said you haven't got a Passport, they look confused, as if only a Passport really proves your ID.
Was it like that 10-20 years ago, of course not.

I think so, even if I only had an expired passport for a number of years.
But do you know, when I renewed my Passport at Passport Office they renewed with minimal checks

it now transpires they werent going to pay him anyway for the 2 weeks he has done because 'all worksheets (or whatever) have to be in by the 18th of each month in order to be paid' and thus wont be paid anyway until the end of december.
so happy christmas. thanks for that. im getting in a complete state over this now. having already been served an eviction notice for the paltry amount of £300 arreas a month or two back (when loads of merton tenants owe in excess of £1k in arrears) im concerned about keeping a roof over out head in what should be a special time considering its our daughters first birthday and christmas (though not her first) that she can/will be excited about.
i will also end up in court (again) over unp[aid council tax as we are a month behind already (caused by extended maternity leave and financial strife. hence i returned to work sooner than i said i would after maternity leave).

The government link is still down, but I've done a search and found this link for you. From my reading of the combinations of documents that can be used to prove identity, it seems to me that if Mr Mob provides something with his NINO on it, such as a P45 or P60 or correspondence showing his NINO from the Jobcentre, plus his birth certificate, plus his Mum's marriage certificate to show why his name changed, then that should be sufficient. Add to that his expired passsport, then surely that's enough? I can't understand why they won't accept the expired passport; it might be out of date, but he must have been entitled to it, and was who he said he is, when he got it.
I can understand the not going to pay him because the worksheets weren't in bit though, not that it helps you. A colleague and I started work on the same day, which was actually the cut off day for the payroll run, and they rushed us down to personnel to get things filled in so that our details would make the run. If they hadn't, we'd have gone six weeks without being paid too.
I know it's easier said than done, but try not to fret too much. Once this is all sorted out, you'll be in a position to get yourselves back on your feet financially. If you do get taken to court, which is a frightening thought I know, whoever is hearing your case is going to be more sympathetic than the LA. Once you explain your circumstances they will let you agree reasonable amounts to repay and it is highly unlikely indeed that you will be evicted.
