Possible online photo misrepresentation

  • The company is DFS! yes, it seems all their stuff is made to order. I'm afraid I can't post a link to the product as they have removed it from the website. They rotate the stock on a regular basis. But their current Large Two-seater sofa bed models are displayed in exactly the same way - made up as double beds and no bed dimensions. I still feel strongly that is is misrepresentation, particularly since they don't state the dimensions.

3 and half months to arrive, sounds like made to order. DSR out the window then.
I think the DSRs do still apply.

My understanding is that made to order products are covered.
It is custom made to customer's specification that is not covered.

Paragraph 3.38 on page 22 of the OFT's guide to DSRs seem to confirm this...
3.38 Unless you have agreed that they can, your consumers cannot cancel if the order is for:
the supply of goods made to the consumer’s own specification such as custom-made blinds or curtains. But this exception does not apply to upgrade options such as choosing alloy wheels when buying a car; or opting for add-on memory or choosing a combination of standard-off-the shelf components when ordering a PC, for example

    - cancellation within 7 days - is that 7 days from order or from delivery?
It's seven working days starting the day after delivery.
Paragraph 3.23 of the above document has details.

Ordered a large two seater sofa bed from a large company online. The website picture showed the sofabed opened up and made up as a double

Im confused, how was it shown as a double? was it unfolded with 2 pillows at the top?
Im quite skinny and so is my wife so i would think it was fit for purpose for us.
A double sofa will not be the same size as a double bed. You bought a sofa at the end of the day that converts to a bed.
Not a double bed that doubles as a sofa.

I'm argee you purchased a 2 seater sofa, the converts to a bed, that just so happened to have 2 pillows on it in the picture. I can't see any comments about the bed size. Fit for purpose yes as a sofa, does it have a bed in it yes. So fit for purpose there as well.

I think your unhappy with your purchase and now trying to find ways of sending it back. If the bed part was of main concern, you could have checked before purchasing.

DSR's are for precisely this situation - they offer a no risk option to reject the goods after inspection

Not quite no risk in this case. DFS charge 20% of the price of the furniture to collect if the purchaser can not deliver to the depot.

Which is a little high I feel.

But at the same time I also feel it's good that companies charge for returns, how is any company meant to make any profit if the customer is allowed to have goods delivered and pick up free of charge if you don't like them.

By selling good quality products which are fit for purpose and at a fair price. By analysing DSR returns, a company will understand its market and be able to adjust its product range to reduce returns. But you knew that anyway.
