Like I said above this, you are not allowed to say whatever you want to get someone to sign a contract. If you say I am buying a USB stick for £3 then when I sign I am allowed to assume this is true and if it is not the contract is worthless. I would have to prove this, and if I did either pay the original £3 or return the USB but the contract is legally unenforceable.

Do look it up sometime if you still do not believe me (you don't have to, obviously), it is interesting and could even help you in the future.

I can agree on those final points :D, have good day (what is left of it).

Fundamental flaw in your argument - the gym have said nothing that is untrue. You have established no right to rescission.

It ain't arcon5 who needs to look it up.

i repeat, the gym has done nothing wrong. Their services are still available. The OP chooses not to use them for reasons of convenience.

But what about the OP's life choices? Surely they are more important than a document as meaningless as a contract? :T

mabrookes - what is your opinion of this analogy?

A group of students sign a tenancy agreement with a private landlord which states, among other things, that they can stay there between September and the following July (so for the full academic year) and their rent is due at the beginning of each month for that month.

However, in the last week of October, the landlord decides to relocate to be close to his elderly parents, after an incident over the weekend, and doesn't want the responsibility of having to be a landlord at a distance, so decides to sell the house.

He phones the students on Tuesday and says, "right lads, I need my house back by Friday, so you'll need to be out by the end of Thursday" (which is 31st October, so they currently haven't paid beyond then).
