creditors are going to bankrupt us.

Hi all, I really need some advice please.

I've been trying to get my debts sorted and have made some headway with the smaller ones. I have been in touch with the CCCS and we have a counsellor and a client number. We've been trying to get our budget sorted and it has needed ammending 2 or 3 times now. In this time the people we owe the largest amount to (25k) are being really hard to deal with. It started with lloyds, then quickly got passed to a debt collector, Then it got passed to someone else who said they were going to file for bankruptcy, and now they've passed it on to bishop investigations and security services. I got a letter from them this morning saying i have 7 days to contact them to arrange an appointment for them to arrange service of a statutory demand issued under the insolvency act.

I am absolutely terrified and at my wits end. My councellor said if they file we won't have to pay the charges and all our debts will be taken into account. We live in a council house so have no assets. What i'm really worried about is the smaller things. I have a v reg zafira that i need. I have a daughter that receives DLA and we need the car for hospital appointments. I've also got the kids a game cube for christmas. Will they take that? They've all got a little portable tv and dvd player each. Will they take those? I'm really worried they're going to come in and strip my house bare? I'm so scared about the implications for the future as well. I've read somewhere that they can class your pets as monetary value as well. I feel like packing my kids up and dissapearing because this is all so hopeless. It doesn't matter what i do or how hard i try it all goes belly up. I can't bare the thought of my family finding out. I can't find any of the letters i had for all my creditors. I've got thema ll together somewhere but where they've gone, i don't know. I've had the whole house upside down. We're going to lose everything aren't we?

    Hi - please don't panic!

    I haven't been through bankrupcy myself, but these are the bits & pieces of info I've picked up being on here:

    They won't take your car if you can prove you can need it for work, and I would presume with a disabled child it would be the same
    Pets - I should imagine this would only be if you had a pet of real monetary value (i.e. pedigree dogs, rare animals)

    Don't know where you stand on the electrical goods - hoepfully someone more in the know will be along soon.
    Have a read of some of the bankrupcy threads - for many people on here it's been a relief to get it all over with

    You have absolutley nothing to worry about with regard to your children's possessions and the chances of losing a V reg Zafira given yr personal circumstances are fairly remote. What you really need help with is how to deal with the creditors that are plaguing you amd again be reassured that they are almost impotent and can't do anything without a county court judgement against you, and even then you are not required to give them access to your house.

    Read the Bankruptcy and Bankruptcy Supporters Club Thread - there's invaluable advice and first hand accounts of people who've lived through what you're going through and come out much happier people.

    Haven't got time to give more specific advice cos I'm at work but DON'T WORRY, you're in the right place to deal with these creeps.

    Thankyou all. I'm sat here with such a big knot in my stomach. Do i need to contact the people who have sent me the letter this morning?

    if you have no real assetts (like a house for example or a high value car) the its very very unlikely they will make you bankrupt...it costs them money to do it and they gain nothing in return.
    they say these things to try to panic you into paying them money that you can't afford.
    if and i say if you were made bankrupt the OR (official receiver ) would not be interested in any of your household items....the vast majority of bankrupts never have any visit to their homes at all.

    if you read this board for a few weeks you will see lots of posts with people panicking because some debt collector is threathening all sorts of things.

    i haven't seen your SoA but of course bankruptcy may be in your best interest but i assume CCCS have already given you advice on this.

    If they contact you, do not discuss paying anything with them, simply say you are with CCCS and give them your number...thats all nothing else , do not try to discusss or reason with them...just repeat that you are with CCCS etc.

    The cccs have worked out we have £149 a month to pay all out creditors. They said let them make us bankrupt. All our debts will be taken into account and we will probably have to pay something each month for a specified time. They did say they would probably get snotty because we both smoke and they wouldn't let us have those costs the cccs have allowed us.

    in answer to your last question is yes you should contact them.

    just let them know you are dealing with CCCS and that they will be intouch (give thenm your ref no.)

    dont let them bully you!

    If it would take a weight of your mind to ring these people, then ring them and tell them that you're working with CCCS who will contact them in the near future. DON'T make any offers of payment and don't get drawn into any conversations that will inevitably lead to them making all sorts of vile threats against you.

    I appreciate you don't realise it at the moment but you are in a good position to get all these debts behind you and start looking forward to a new start. It's a difficult road to travel but well worth the effort.

    You say the biggest debt is to Lloyds? I hope that you have checked how much of what YOU owe THEM can be offset by what THEY owe YOU in the return of illegal banking charges.
    Also, given that drug addicted, convicted fellons recently sued the prison service for not giving them access to drugs (i.e cold turkey), surely you could claim the right to buy cigarettes under the same act?
    However, if you can give up you will obviously be better off in both wallet and healthwise.

    I did manage to stop for 3 weeks, but gave in one night. Stupid, i know. The thing that is really annoying is that when we tokk the loan out with lloyds about 2 or 3k of that was for insurance. When my hubby had his accident and went on incapacity i rang them to ask if we could ise the insurance. They said to ring them back when he was claming benefits for three months. I asked them to reduce the payments to help. They refused. By the time we could claim on the insurance they had already issued us with a default and sent it to another company.
