do I have to replace after an insurance claim

Hello All, - I need advice,

Myself and my partner have claimed after a contractor damaged our flooring - they have liability insurance and have admitted negligence - my partner has been made bankrupt recently and we are struggling financially - although I've been told the floor is repairable in places I was advised not to and it was agreed to replace it all - if the insurance pays out for a full replacement are we entitled to repair it as our choice and live with the reduced appeal of the unreplaced portion thus keeping the rest of the money to help us out ?

    you may get a cash deal, depends on company
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    I would suggest that you speak with your Official Reciever, as there may be problems with you receiving additional money while your partner is not discharged.

  • I wouldn't speak to anyone and would simply get the cash for the floor.

    I had a damaged floor and took the money. The loss adjuster made noises about them getting involved but I quickly closed the door on that one. Thinking about decorating, a new colour scheme, new furniture or even moving or doing building works necessitating delaying installation could potentially be excuses. If you get quotes to replace it, then they should simply pay out the cheapest. You can of course manage the quotations you give them.

    If you are both named on the policy, deal with themself, not in your partners name.
    Be aware that if you don't replace the floor, don't invite them back for similar future claims, as they will record the fact they have paid to replace the floor.
  • Hello All,

    there is no policy as the contractor is paying via liability insurance but the contract for work was with me in my name only so my common law wife (probably should have made that clear)who has a different surname is surely not involved - compensation is owed but not sorted - would this be affected if I do not carry out the work also ?
